Terms & Conditions

These Terms and Conditions ("Terms") govern the booking and use of the vacation rental property located at LaCasa Lakeside Resort, Kelowna, British Columbia, operated under the business name Okanagan Cottages ("we," "us," "our"). By making a reservation, you ("Guest," "you," "your") agree to be bound by these Terms in their entirety.

1. Rental Agreement

A binding rental agreement is formed when we confirm your reservation and receive the required deposit payment. This agreement is between the Guest named on the booking and Okanagan Cottages. The Guest named on the booking must be at least 19 years of age and must be present for the duration of the stay.

2. Rates, Fees & Payment

All rates are quoted in Canadian dollars (CAD). Rates are subject to applicable taxes: 5% GST (Federal Goods and Services Tax), 8% PST (British Columbia Provincial Sales Tax), and 3% MRDT (Municipal and Regional District Tax), for a combined tax rate of 16%.

A non-refundable cleaning fee of $200 CAD applies to all stays. The cleaning fee is waived for stays of seven (7) nights or longer.

Payment schedules vary by season and booking lead time as outlined on our Your Stay page. Failure to remit the balance by the due date may result in cancellation of the reservation.

3. Security Deposit

A pre-authorized hold of $500 CAD will be placed on the Guest's credit card prior to arrival. This hold does not constitute a charge. The hold will be released within seven (7) days following checkout, provided no damage, excessive cleaning, or policy violations have occurred.

In the event of damage or a policy violation, we will provide written documentation including photographs and itemized costs prior to capturing any portion of the pre-authorized amount. If the cost of damage exceeds the security deposit, the Guest is responsible for the balance.

4. Cancellation Policy

Cancellations must be submitted in writing to info@okanagancottages.ca. The effective date is the date we receive the written cancellation.

  • 30 or more days before check-in: Full refund of all payments
  • 14 to 29 days before check-in: 50% refund of total booking amount
  • Less than 14 days before check-in: No refund

No-shows and early departures are non-refundable. We strongly recommend travel insurance for all bookings.

5. Occupancy & Use

Maximum occupancy is six (6) persons. The property may not be used for any purpose other than personal vacation accommodation. Commercial use, events, parties, filming, and photo shoots are prohibited without prior written consent.

The Guest is responsible for the conduct of all persons on the premises during the rental period, including day visitors. A maximum of eight (8) day visitors are permitted per day in addition to registered overnight guests.

6. Pet Policy

Dogs are permitted subject to the following conditions: a non-refundable pet fee of $150 CAD applies for the first dog and $75 CAD for a second dog. A maximum of two (2) dogs are permitted. A separate refundable pet damage deposit of $500 CAD (pre-authorized hold) is required in addition to the standard security deposit.

Guests must provide a signed pet addendum, photograph of the animal, and proof of current rabies vaccination prior to check-in. Full pet rules are detailed on our Your Stay page.

Service animals are exempt from pet fees and deposits in accordance with the British Columbia Human Rights Code. Guests with service animals are asked to notify us in advance.

7. Smoke-Free Policy

The interior of the property is entirely smoke-free. Smoking of any substance (including e-cigarettes and vaporizers) inside the property will result in a restoration fee of $300 CAD. Smoking is permitted on the patio only, provided it does not cause a nuisance to neighbouring properties.

8. Quiet Hours & Conduct

Quiet hours are 11:00 pm to 8:00 am daily, as established by the LaCasa Lakeside Resort strata corporation. Noise audible from neighbouring properties during quiet hours is deemed unreasonable. Violation of quiet hours or disruptive conduct may result in immediate termination of the rental without refund.

9. Liability & Indemnification

The property is provided "as is." We are not liable for any injury, illness, death, loss, or damage to persons or property arising from the Guest's use of the property, resort amenities, lake, pool, hot tub, or surrounding areas.

The Guest assumes all risk associated with recreational activities including but not limited to swimming, boating, and use of resort facilities. There are no lifeguards on duty.

The Guest agrees to indemnify and hold harmless Okanagan Cottages, its owners, agents, and representatives from and against any claims, damages, losses, or expenses arising out of the Guest's use of the property or breach of these Terms.

10. Force Majeure

Neither party shall be liable for failure to perform obligations under this agreement due to circumstances beyond reasonable control, including but not limited to natural disasters, wildfires, flooding, pandemic, government orders, acts of war, or utility failures. In such events, we will work with the Guest to reschedule or provide a credit for future use.

11. Resort Rules

The property is located within LaCasa Lakeside Resort, a strata community governed by its own bylaws and rules. Guests are required to comply with all applicable resort rules, including but not limited to pool and hot tub hours, marina regulations, parking restrictions, and pet policies. The Guest acknowledges that resort rules may be updated from time to time by the strata corporation and that compliance is mandatory.

The owner is financially responsible for all fines resulting from Guest violations of resort bylaws or rules.

12. Guest Registration

All guests must be registered prior to arrival. A Guest Registration Form and Amenity Pass are required by the resort before the rental period begins. We will facilitate this process as part of the check-in procedure.

13. Privacy

Personal information collected in connection with a reservation is handled in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA). We collect only the information necessary to process reservations and ensure guest safety. We do not sell, rent, or share personal information with third parties except as required to process the booking or comply with legal obligations.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.

15. Registration & Licensing

This property is operated in compliance with all applicable provincial and municipal regulations.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with your booking confirmation and any signed addenda (including the pet addendum where applicable), constitute the entire agreement between the parties regarding the rental of the property. No oral agreements, representations, or warranties not contained herein shall be binding.
